Port Of Baltimore: How To Prevent Federal Audits Related To Leased Drivers

Are you concerned about federal audits and being cited for issues relating to leased drivers?

If yes, you are not alone.

Driver Qualification files for leased drivers are on the rise.

A motor carrier recently had to undergo a federal audit for utilizing leased drivers and the motor carrier was cited.

Why was the motor carrier cited?

The motor carrier had no records of pre-employment drug tests and driver qualification files.

It is required that leased drivers be enrolled in drug and alcohol testing programs.

The motor carrier and leasing company must have separate driver qualification files and drug and alcohol testing. This is mandatory because the motor carrier and leasing company have completely separate and distinctive motor carriers.

You do not want to be cited by a federal auditor.

The Federal Motor Carrier Safety Administration (FMCSA) and the Office of Drug and Alcohol and Compliance for the U.S. Department of Transportation are making it a requirement that driver qualification files are separate for the motor carrier and the leasing company.

As for leased drivers that are veterans, the state of Maryland has launched a skills test waiver for veterans.

This was finalized in 2012 by the FMCSA. The veteran skills test waiver will authorize the state of Maryland to allow veteran state drivers to waive the skills portion of the CDL test if the veterans have at least two years of safe driving completed for the military. This is equivalent to the driving a commercial motor vehicle.

CARB Implements The Diesel Filters Rule in California

It’s 2013 and things are changing in the trucking industry once again. Since January 1st, 2013 the California Air Resources Board (CARB) has designated a diesel filters requirement in California.

The Diesel Filters rule by CARB will impact all heavy-duty trucks and buses traveling into California.

The Diesel filters will require all heavy-duty truck drivers and bus drivers with 2000-2004 model year engines to install diesel soot filters.

The only exception goes for low-mileage or emergency vehicles. It should be noted that non-compliant vehicles might not be eligible to legally operate in California.

Anyone driver who violates the rule will be penalized $1,000 and over per violation, per month.

October 1st New Maryland Law Will Force Overweight Trucks To Off Load

October is only a few days away and a New Maryland Law will be in full effect for Truck Drivers. What is this new law? The New Maryland Law revolves around Overweight Vehicles with perishable products.

Starting October 1st, if you are a truck driver carrying an overweight perishable products load, you will automatically be off-loaded.

This change in Maryland law will affect all truck drivers whom exceed the gross vehicle weight limit by more than 5,000 lbs.

Prior to this new Maryland law, overweight vehicles were simply issued a citation rather than being forced to off-load.

Trucks are always more of a hazard when they are overweight and overloaded because the trucks can lose control by making any sudden moves. Here are a few tips on how to prevent overloaded truck accidents:

–      Make sure your commercial truck weight distribution is appropriate. It helps the truck handle itself in a number of circumstances.

–      Know how heavy your load can be, the combined weight of the load and truck and how much weight can each axle endure ( and don’t forget how much weight your truck tires can endure). This will help your truck not be forced to unload at checkpoints and most importantly you can be assured you are safe on the road.

–      Do your best to create distance in front and behind you, so your truck can stop properly and safely when necessary. Too much weight creates an unsafe shift in your load and increases the possibility of you losing control of steering capabilities. Remember big rigs and overloaded trucks are more likely to roll over.

Maryland Truck Company Forced to Shut Down by FMCSA

A Maryland trucking company, Gunthers Transport, LLC, was forced to close last year after it was issued an “imminent hazard out-of-service order” by the U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA). This was after a FMCSA safety review of the company’s operations found several hours-of-service and vehicle maintenance violations. It was determined that these violations substantially increased the likelihood of serious injury or death to the motoring public.

  1. Gunthers Transport allowed its drivers to falsify their hours-of-service records and exceed the 11-hour limit for daily driving.
  2. Gunthers Transport did not require its drivers to perform pre-trip vehicle safety inspections.

“Safety is our number-one priority,” said U.S. Transportation Secretary Ray LaHood. “Commercial truck companies that recklessly disregard federal safety regulations will be shut down and removed from our roadways.”

Just as truck maintenance is crucial before the frigid winter weather sets in, so too is it crucial before the scorching summer weather takes affect. The typical hot, dry, and humid summer weather here in Maryland causes additional stresses on your truck. This makes spring (NOW!) the perfect time to address truck maintenance.

Summer Truck Maintenance Tips

  1. Cooling System Issues: An estimated 40 percent of downtime is caused by cooling system problems, problems that are 100% preventable. So be sure to perform routine engine maintenance to ensure that your truck is running as efficiently as possible.
  2. Engine Coolant: Your engine coolant should be checked every 500 operating hours, 20,000 miles or three months, whichever comes first. It is important to not only monitor coolant levels, but also color. Coolant that appears cloudy or has particulates floating could be an indication of bigger problems.
  3. Tire Pressure: The most critical factor in tire maintenance is proper inflation. Proper inflation leads to proper contact with the road, which will improve traction and braking capabilities. It will also ensure your tires last longer.
  4. Electrical Systems: Be sure to check the alternator’s wiring, battery, battery cables, and the wiring from the engine’s electrical controls. Make sure everything is in proper working order, wires are not frayed and there are no signs of corrosion.

Trucking Industry News: Handheld Cell Phone Ban for CMV Drivers

As of January 3, 2012, the Federal Motor Carrier Safety Administration’s final rule banning handheld cell phone use officially went into effect. The rule bans all interstate commercial motor vehicle drivers, interstate HAZMAT drivers and intrastate HAZMAT drivers from holding, dialing, and even reaching for a mobile phone.

Any driver found in violation of this rule will face civil penalties up to $2,750 for each offense. Drivers with multiple offenses (two or more violations in three years) risk disqualification from operating a Commercial Motor Vehicle (CMV).

Companies found allowing drivers to use handheld devices – including “push-to-talk” – while driving face a maximum penalty of $11,000.

CMV drivers who wish to still use a mobile phone or other handheld device must use a hands-free device, located in close proximity, which requires the pressing of no more than a single button to initiate or terminate a phone call.
