Port Of Baltimore: How To Prevent Federal Audits Related To Leased Drivers

Driver Qualification files for leased drivers are on the rise.

A motor carrier recently had to undergo a federal audit for utilizing leased drivers and the motor carrier was cited.

Why was the motor carrier cited?

The motor carrier had no records of pre-employment drug tests and driver qualification files.

It is required that leased drivers be enrolled in drug and alcohol testing programs.

The motor carrier and leasing company must have separate driver qualification files and drug and alcohol testing. This is mandatory because the motor carrier and leasing company have completely separate and distinctive motor carriers.

You do not want to be cited by a federal auditor.

The Federal Motor Carrier Safety Administration (FMCSA) and the Office of Drug and Alcohol and Compliance for the U.S. Department of Transportation are making it a requirement that driver qualification files are separate for the motor carrier and the leasing company.

As for leased drivers that are veterans, the state of Maryland has launched a skills test waiver for veterans.

This was finalized in 2012 by the FMCSA. The veteran skills test waiver will authorize the state of Maryland to allow veteran state drivers to waive the skills portion of the CDL test if the veterans have at least two years of safe driving completed for the military. This is equivalent to the driving a commercial motor vehicle.
